Louisiana - SB 148 - 2015

Proposing to amend Article IX, Section 4 of the Constitution of Louisiana, relative to natural resources and reservation of mineral rights and prescription; to provide relative to lands and mineral interests of the state, a school board, or a levee district; to provide that private purchasers of such lands shall gain the ability to acquire these entities' mineral interests upon prescription resulting from nonuse; to provide certain terms and conditions; and to specify an election for submission of the proposition to electors and provide a ballot proposition.

Very good idea, these rights should transfer. The term of prescription resulting from nonuse, should not be increased as well.

As a land owner and conservationist revitalizing Longleaf pine forests, I see this bill as a critical step towards preventing mineral lights on my land from being leased by the state and then oil drillers showing up destroying my property.

This has happened in the past and we must stop it now.

I don't see this getting passed and allowed to be voted on this year. Not with this much need in the budget.

Thank you for helping to restore Longleaf Pine forests. As a native of NC, I miss those pines!

The state retains the mineral rights of these properties under the thinking that it could be used to pay off the taxes owed. However, once the property is acquired by a willing tax payer nothing has been done to transfer the rights back to the new owner.

Again, the true issue here is the state leasing the mineral rights to a drilling company who then enters the new owner's land. In my case, the land is part of fragile conservation activity replanting native Longleaf pine and creating a habitat for various forms of endangered Louisiana wildlife.
