I recently had to move out of my apartment before the lease was up due to severe financial problems. I discussed my situation with the landlord and gave a 30 day notice. I knew that I would owe rent until they could lease my apartment, but I was stunned when I received a bill for over $1100 in carpet damages!! The letter I received noted, "excessive stains". I totally disagree. I moved into the apartment in 2011. The carpet is the original carpet from 2008, when the complex initially opened! Does the landlord have a right to charge me full price for new carpet when the carpet was not new when I moved in? When I moved out, the carpet was 7 years old. Please advise.

normal wear and tear are normally not a deposit chargable thing...

anything beyond normal wear and tear can be grounds for additional $$$ due to damage -
including stains, holes in the walls, torn screens, plumbing not maintained, etc.

Did you have a walk through/inspection upon move in? was the carpet already stained then?
do you have documentation of the condition upon move in?

good luck!
