My employer has been deducting (double) the amount of health insurance premium. For example, my coverage should be say $500 a month, employer was deducting $500 every pay period (bi-weekly paid) total of $1000 each month for health insurance.

I contacted HR and informed them regarding this error. They acknowledge the error and went back as far as 2013. I was giving a note from HR to indicating that $6000 is the amount that should be returned to me by next pay period.

I check my bank and money was deposited to the account but not the full $6000. here are some questions I have.

1. should this money be taxable
2. is this money consider to be part of my gross income
3. my interpretation that I already paid taxes for this money and I should not be taxed again
4. where can I find resources in this topic laws/rules/ regulation
5. is this standard in payroll or my company is unique or doing something illegal
Thank for any assistant

My first thought is to check with other employees to see if it happened to them as well. Probably an honest mistake but it does make you wonder.

in answer to your question health insurance is a pre-tax deduction so yeah the money is taxable. Problem you have is the big refund is taxed at a higher rate. But it will all wash out when you file your taxes.
