Another question is do you have the right doc completing the form? Do you need a specialist who is better able to render an opinion?

I applied and was approved in 10 days. My disability was listed in the social security "blue book" (that is what they use to approve/disapprove medical conditions) I had submitted all the necessary forms and had made copies of my medical files and submitted it on my first office visit.

For the majority of folks applying for disability, their impairment(s) are not going to satisfy the criteria for meeting or equalling the Listings (the Blue Book criteria mentioned by the previous poster). For most people, the determination is based on their residual fucntional capacity (RFC) that is their physical and/or mental limitations as determined by the disability team reviewing their case, combined with their age, education, and types of work they have done in the past 15 years. Under the age of 55, it is difficult to be found disabled based on an RFC but there are exceptions. It is always crucial to discuss chronic pain, fatigue, side effects of medications or other treatments, not only in the disability application, but to your doctors so that their records reflect that you do regularly complain of these symptoms when you are seen by your doctor. Regarding having your doctor complete forms; your best bet is to contact the person reviewing your claim and ask them to send YOU forms for your doctor to complete. If your doctor is willing to do so, hand them to him/her and ask that they be completed ASAP and returned. Many times doctors are flooded with tons of medical records requests and have staff who don't have time to send the correct records. If you hand deliver the forms to the doctor and he/she agrees to complete them, you have a much better chance of ensuring SSA gets the evidence they need to make the correct determination.

I Filed for my disability back in 2008. I was denied the first time, so I contacted a Disability Lawyer and he took my case. It is now 2010, and he told me that I will get my disability. I would like to find out how much money would I be getting since I filed in 2008. If there is anyone out there who knows how the payment is figured out, I would like to hear from you. Thanks

Do they pay from the time the claimed was filed? I would really like to find out. Thank you for responding.

You will be awarded as follows

example
Date claim filed 5-1-2009
Date of onset 4-8-2009

You are awarded for dib on 5-1-2010

The law states that you must have a waiting period of 5 months before you are able to draw benefits. So your Date of entitlement will be 10/2009. Your past due period will be 10/2009 until 9/10. Your lump sum check is based on those months.

If you look at your annual Social Security Statement it will tell you what your monthly payment would be if you go on disability. No one here can tell you without knowing very, specific and personal details about your claim and work history. If you are receiving any workers' comp payments-there will be an offset applied and that reduces the amount of disability you are entitled to. Garnishments can also affect your monthly cut.

Others I see and talk to are in wheelchairs or walking on crutches, are on oxygen tanks and can't even walk 10 feet because of leg or back injuries, and they were denied SSD.

Please, explain this to me. I have read all the booklets, all the web sites and every magazine article I can find and still don't understand how they can turn some people down and give it to others. Please tell me your story. How long was it after you first filed before you got your yes or no? Did you file an appeal if denied, and if so, how long before the hearing, and did it go to trial or was it settled right before trial? If you got it, but had to file an appeal to get it, what was your story and how much did they owe you in back payments? How did you and/or your family survive on no money coming in, waiting to hear about the SSD. I have been out of work for 9 months now, and I don't know how much longer I can hold out. We have not asked for any help from relatives, but it is getting harder and harder.

I am just trying to understand the system and how it works. Everybody says: "they turn everybody down the first time". Is this true? Do they follow you around with cameras to support your claim? I just want to hear your story or a friends story or a relatives just because I honestly am curious about the hardship this puts on families waiting for a case worker to look over your medical evidence and to either decide yes or no.

I would really appreciate hearing from people and sounding off if you need to about the system, about your diagnosis, about how your family survived waiting, and if you had to change your mind and give in, and go back to work in pain because of the amount of waiting time. Thank you from the bottom of my heart if you answer me. This would not only help me understand, but could help others as well who may also have to apply for Social Security Disability because of catastrophic events and injuries.

Did you finally get approved. I too had back problems, no surgeries
I did get approved finally by hiring a attorney, They did take a year of my money, by changing the onset date, but got approved. Hire attorney
most important thing to do. It took me 33 mos but 37,000.00 back pay check. Good luck..
