Hi,
I'm looking to get some information wrt the following situation.

My wife's looking to quit her job but her employer has a 90-day notice period. As per employment t&c, they 've said that they will ask her to reimburse $500/day of the # of days left if she doesn't complete the notice period. When she brought this up with a friend, she said that Mass is a 'no contract' state and that employers can't do this in mass. We tried googling about this but couldn't find any relevant sites. Has anybody else come across this term or has experienced something similar?

I am by no means a legal expert, but I'll share my experience. It's true that Mass is a "no contract" state in the sense that your wife's contract is null and void if she didn't receive value for it. In the case of my contract, it was renewed yearly when I received either a raise or a bonus. Our in-house counsel told me it was still a gray area in the legal world and if taken to court would be ruled on a case by case basis. I personally wouldn't test it because there's a chance you will be ordered to pay up. I wouldn't trust legal advice over the internet either.
