Too late for us but just out of curiosity and for future reference…

When buying a house that is just going to be build…Who is writing the "punch list" with all the specifications? Like what toilets to be installed, what materials to be used, what carpet is chosen…lighting, handles and all that?

Those are "specifications" not a "punch list" and are generally agreed upon by the buyer and general contractor at the start of construction. In many cases, the builder will just provide an allowance for those items and the buyer will choose from an approved source.

As GF mentioned, what you're talking about is the specifications list. The punch list is something you give to the builder toward the end of construction which is a list of items that need to be repaired/completed. It could be paint touch ups, fixing a window that doesn't open, or replacing a tile that was installed incorrectly but usually it's a list of little things.

As for who decides on the specifications . . . well that's going to depend on the situation. If you're doing a custom build then you'll decide on nearly every little door knob, drawer pull, toilet, etc. that's going in the house. If you're buying a spec house (which if recall correctly is what you did), it will depend on what stage of construction the house is at when you agree to buy it, what materials the builder has already purchased or committed to purchase, and how flexible the builder is willing to be. Some builders don't want to be held up for weeks on end waiting for you to make a decision on toilets (time is money as they say) and so they will limit what items you can choose. Depending on the builder you may be given a range of options or you may be given an "allowance" so that you can pick whatever you like. If you do have an allowance and pick something that costs more than your allowance you will be on the hook for the extra cost.

There's not really a simple answer to this question except for "it depends." By the way, did you ever sell your house in Belmont?

I just wanted to confirm that it is not something that broker or lawyer was supposed to do. We just had a small argument on that in my family

Both the punchlist and specifications should be written by the Architect. We are contractually, and legally, obligated to do so. However, in design-build environment, the Architect is employed by the contractor.

Specifications are part of the construction documents and must be written before construction begins.
Punch lists are part of closeout. When the items listed by the Architect on the punch list are done to satisfaction by the GC, the Architect will sign off on substantial completion so the GC can get a certificate of occupancy and get paid (by you).

It sounds like there is more than one punch list then. I've personally never seen a punch list from an architect, but that makes sense that there would be one. The buyer of the house definitely generates their own punch list though.

I would also imagine that the architect's specification list might be a little different from one the builder might hand out to a potential buyer. For example, I'm guessing the architect's list would have less detail and might say something like toilet whereas the builder's list might say Kohler Memoirs toilet, white with elongated bowl. The architect's list might say something like tile floor whereas the builder's list says 1' x 1' Carrera marble tiles. Am I correct on that?

Maybe? I know an architect creates a punch list as a construction control.

Just a sample: one project, almost 15 years ago, I had a roofer walk and break every single ridge vent on a shingle roof. About 150,000 sf of roof area... Until those ridge vents were replaced, the contractor wasn't getting paid.

Opposite, actually. There are a few places that actual materials are called out on CDs. On a finish schedule, you might call out an acronym, naturally if you've got a few hundred rooms in a building, your not going to go into detail, you'd call out CT-1, CT-2, VCT-1, CPT-1, etc for floor finishes. On a plumbing schedule, often written by a mechanical engineer, it would call out TLT-1 is Kohler K-3999 Highline with Kohler xxx flush handle.

You often have a schedule of schedule acronyms, so that CPT-1 would be "Mannington Teres Parchment, broadloom", or CT-1 is "Daltile HL06 Heathland Sage, pattern to match finish plan".

The specs would be a 3 part spec. There are a few ways to write specs, but one common way would be prescriptive specs. The specs prescribe the exact materials to be used.

Below is Daltile's prescriptive spec they'd like you to use if specifying their floor tile.

1.4 PERFORMANCE REQUIREMENTS

A. Static Coefficient of Friction: Tile on walkway surfaces shall be provided with the following values as determined by testing in conformance with ASTM C 1028.
1. Level Surfaces: Minimum of 0.6 (Wet).
2. Step Treads: Minimum of 0.6 (Wet).
3. Ramp Surfaces: Minimum of 0.8 (Wet).

1.5 SUBMITTALS

A. Submit under provisions of Section 01300.

1.6 QUALITY ASSURANCE

1.7 DELIVERY, STORAGE, AND HANDLING

B. Protect adhesives and liquid additives from freezing or overheating in accordance with manufacturer's instructions.

C. Store tile and setting materials on elevated platforms, under cover and in a dry location and protect from contamination, dampness, freezing or overheating.

A. Do not install adhesives in an unventilated environment.

B. Maintain ambient and substrate temperature of 50 degrees F (10 degrees C) during tiling and for a minimum of 7 days after completion.

PART 3 EXECUTION

3.1 EXAMINATION

A. Verify that wall surfaces are free of substances which would impair bonding of setting materials, smooth and flat within tolerances specified in ANSI A137.1, and are ready to receive tile.

B. Verify that sub-floor surfaces are dust-free, and free of substances which would impair bonding of setting materials to sub-floor surfaces, and are smooth and flat within tolerances specified in ANSI A137.1.

C. Verify that concrete sub-floor surfaces are ready for tile installation by testing for moisture emission rate and alkalinity; obtain instructions if test results are not within limits recommended by tile manufacturer and setting materials manufacturer.

D. Verify that required floor-mounted utilities are in correct location.

3.2 PREPARATION

A. Protect surrounding work from damage.

B. Remove any curing compounds or other contaminates.

C. Vacuum clean surfaces and damp clean.

D. Seal substrate surface cracks with filler. Level existing substrate surfaces to acceptable flatness tolerances.

E. Install cementitious backer board in accordance with ANSI A108.11 and board manufacturer's instructions. Tape joints and corners, cover with skim coat of dry-set mortar to a feather edge.

F. Prepare substrate surfaces for adhesive installation in accordance with adhesive manufacturer's instructions.

3.3 INSTALLATION - GENERAL

A. Install tile and grout in accordance with applicable requirements of ANSI A108.1 through A108.13, manufacturer's instructions, and TCA Handbook recommendations.

B. Lay tile to pattern indicated. Arrange pattern so that a full tile or joint is centered on each wall and that no tile less than 1/2 width is used. Do not interrupt tile pattern through openings.

C. Cut and fit tile to penetrations through tile, leaving sealant joint space. Form corners and bases neatly. Align floor joints.

D. Place tile joints uniform in width, subject to variance in tolerance allowed in tile size. Make joints watertight, without voids, cracks, excess mortar, or excess grout.

E. Form internal angles square and external angles bullnosed.

F. Install ceramic accessories rigidly in prepared openings.

G. Install non-ceramic trim in accordance with manufacturer's instructions.

3.4 INSTALLATION - FLOORS - THIN-SET METHODS

B. Over interior concrete substrates, install in accordance with TCA Handbook Method F113, dry-set or latex-portland cement bond coat, with standard grout, unless otherwise indicated.
1. Where waterproofing membrane is indicated, install in accordance with TCA Handbook Method F122, with latex-portland cement grout.
2. Where epoxy bond coat and grout are indicated, install in accordance with TCA Handbook Method F131.

C. Over wood substrates, install in accordance with TCA Handbook Method F142, with standard grout, unless otherwise indicated.

3.5 INSTALLATION - FLOORS - MORTAR BED METHODS

A. Over exterior concrete substrates, install in accordance with TCA F101, bonded, with standard grout.

B. Over interior concrete substrates, install in accordance with TCA Handbook Method F111, with cleavage membrane, unless otherwise indicated.
1. Where waterproofing membrane is indicated, with standard grout or no mention of grout type, install in accordance with TCA Handbook Method F121.
2. Where epoxy bond coat and grout are indicated, install in accordance with TCA Handbook Method F132, bonded.

F. Mortar Bed Thickness: 1-1/4 to 2 inch (32 to 51 mm) maximum, unless otherwise indicated.

3.6 INSTALLATION - SHOWERS AND BATHTUB WALLS

A. At tiled shower receptors install in accordance with TCA Handbook Method B415, mortar bed floor, and W244, thin-set over cementitious backer unit walls.

B. At bathtub walls install in accordance with TCA Handbook Method B412, over cementitious backer units with waterproofing membrane.

C. Grout with standard grout as specified above.

D. Seal joints between tile work and other work with sealant specified in Section 07900.

3.7 INSTALLATION - WALL TILE

A. Over cementitious backer units on studs, install in accordance with TCA Handbook Method W244, using membrane at toilet rooms.

C. Over gypsum wallboard on wood or metal studs install in accordance with TCA Handbook Method W243, thin-set with dry-set or latex-portland cement bond coat, unless otherwise indicated.

3.8 CLEANING

A. Clean tile and grout surfaces.

3.9 PROTECTION OF FINISHED WORK

A. Do not permit traffic over finished floor surface for 72 hours after installation.

B. Cover floors with kraft paper and protect from dirt and residue from other trades.

C. Where floor will be exposed for prolonged periods cover with plywood or other similar type walkways

In this case, if the owner/contractor wants to use a different tile, it would have to be changed, using, usually, a change order. And that costs money. But, if the design is specific, this is the best way to go.

Another type of spec is performance specs. They are written that almost any thing could be used IF it meets the performance criteria numerated in the specs. For example, the toilet spec could say that the toilet has to have a seat height of 16.5" and use 1.28 gpf. The plumber would still supply a shop drawing to the architect/Mech Eng for approval, but any toilet that meets those criteria would be acceptable.

Remember, the GC has no idea what to get if it's not in the construction documents.
