Not necessarily. You are jumping the gun here. Any LL that also occupies rental property is by law allowed to discriminate about their immediate neighbors/tenants.

If I came today to your home to make a lead inspection, because your neighbor thinks that your kid is exposed to unnecessary lead danger, and state wants you to immediately remedy any violations that will cost you in excess of tens of thousands of dollars (even without anyone testing positive for lead), you would be singing completely different tune.

BTW, for all of you who love to bash LL, be honest here.

How many of you, since you bought your own older home, have young kids now, went to pains of spending big money to make sure your home is fully certified deleaded and by the state of MA requirements and to be fully safe for your baby? Or did you feel entitled to it only when you are renting since it is not out of your pocket expense?

There is too much double standard, even schadenfreude, and too little good will and common sense about this issue. If people really cared about lead and its full eradication, there would be million better ways to engage every home owner, regardless if LL or not.

The exemption you speak of applies to an owner occupied 2 family only.

I'm not bashing landlords. It's a business and businesses have expenses. Deleading is usually cheaper than being on the losing end of a lawsuit.

I think you're right that people want things they normally wouldn't get for themselves when someone else is paying for it. I have an unit for rent right now (built in 1982 so lead is not a problem) but I think that most people who asked me about whether or not it was de-leaded did so because they know with the wrong answer I could back myself into a corner due to the threat of a lawsuit. I think that most of these potential tenants don't care one lick about lead and certainly won't incur the cost of doing it to their own house once they own. But I think the point the other guy was trying to make is to not be so, uh... "open" about your screening practices .
