It sounds like negligence but the judge called it misconduct. The breathalyzer machines weren't being calibrated properly.

It's judicial misconduct if the state knows there is a calibration problem and they don't disclose it to the defense attorney. Didn't you watch My Cousin Vinnie? Even Mona Lisa Vito knew that the prosecutor had to give the defense attorney everything.

I mean whats the big deal. You only ruined a couple thousand civilians lives. Why is everyone in such a huff.
