Except that isn't what the repeal does. It now gives teachers the flexibility to report. Under the law, the teacher was required to report little Johnny if he did finger guns at little Jimmy on the playground. Now the teacher can decide whether or not to report it.

Why should the teacher be able make those decisions? Should teachers in Massachusttes be given the option of filing a 51A report? I'm a full proponent of limiting, to the extent possible, unnecessary juvenile involvement with the CJ system but CJ professionals are the experts not teachers. There are plenty, and could be more, criminal justice personnel capable of making those assessments and they can easily be written into law or policy. Teachers should be required to report any potentially concerning violent behavior to qualified professionals and don't necessarily need to result in a criminal record.
