I am disabled with various mental health issues and health issues. the landlord knew this when renting to me. Now I feel he took advantage of me. The home was advertised as 3 bedroom. Turns out it is only 1. I have been here 6 months! I want to move and live out my security. I am giving him 30 days notice tomorrow.

I was to receive financial assistance from 2 agencies.BOTH turned me down saying the 2 bedrooms have no windows. BOTH added the landlord brags about being an unlicenced lawyer(meaning he KNOWS the law WELL, but never attended law school) he knew full well what he was doing.

I want to do right thing and give 30 day notice. And break my lease (reasonable accommodation)because my illness has become worse. Also I want to break without penalty, live out my security. The place had holes in the walls, badly stained carpets, and lots of damage. I took photos of all damages. People are telling me if he lied about the number of bedrooms, he will lie and say the damages were not there.

He knows I have a VERY HARD time speaking up for myself. Part of one of my issues. My neighbor said he played on that.

What would you do? I am screwed now, unable to get assistance. Stress making me sicker. I spent yesterday in a BALL crying! And he KNEW what he was doing. would you live out your security?

Can you find an advocate to help you? If you are on disability, see if there are any local non-profits who assist the mentally disabled and ask if they offer advocate services to help you with business issues.

Seek legal aid help. If your landlord is posing an apartment as 3 bedrooms but two of the bedrooms are not legal bedrooms, that is illegal. You need professional assistance.

WELL! I have an UPDATE!

I decided to call landlord and just try and discuss the situation. I politely asked him if I could live out my security. He said "by all means not!" I said I feel frustrated cause of the damages when I moved in. He said "what damages?" then I put my big girl panties on and finally spoke up to him.

I then said "oh come on now. It's bad enough you advertised this place as 3br and it's really only 1. I can't even get financial help cause you advertised it as 3br & it's really only 1 br cause there are no windows in 2 of the br"

He said "I NEVER advertised that place as 3 br. "

Then I got angry! GOOD FOR ME !

I told him I had to go. I emailed him photos of the damages. ALL of them! With the local newspaper beside ALL with the date on it for proof. (saw that on Judge Judy once) I also had a screen shot of the ad cause I sent it to someone, in which he clearly advertised this as 3 br! Sent that in the email as well.

WELL!.
He called me back a different person. Said he forgot he MISTAKENLY advertised it as 3br. He said, " And by all means live out your security! No Problem" then he calls back and says "Please don't mention my mistake to anyone. It was an honest mistake! You understand don't you, I mean I am letting you live out your security with no problem. And forget the damages, yeah I forgot about those. See we are helping each other out."

!!???????????

I don't want any problems so I am just gonna get the heck outta here. And I asked him to email me something saying he okayed my living out my security.
AND HE DID!

I am so PROUD of myself.

In the future, take photos of each room before signing a lease. Walk through with the landlord and make a list of anything that is damaged; both of you should initial and date the list. Problem prevented.
