Hi guys!

I have been living at my condo for a few months now (1800 Club) and one of the issue that I had when I moved in was that the bathroom fan does not work. The management company told me to call Service America (the landlord has a plan with them) but they do not fix bathroom fans. Since then, the management company has refused to fix this issue and doesn't even answer my emails or phone calls. Me and my girlfriend are getting sick because of all the mold that is forming. The mold is forming because the bathroom fan is not pumping the humidity out.

Can I plainly refuse to stop paying rent until this issue is fixed?

Please help!

No, I don't believe you can just stop paying, but I'm no lawyer.

With that said, why don't you put a regular fan in there to circulate the air, and also make sure you're doing things like squeegeeing the shower walls and tub floor to rid yourself of as much standing water as possible.

There are plenty of ways to prevent mold besides running a bathroom fan.

Is the mold inside the wall or on the walls/tiles? If its on the tile, good old clorox spray will kill it. If its inside the wall then, the landlord will need to rip things out to get rid of it.

No you can't just stop paying your rent

Your air conditioning will help the humidity, you can always buy floor fans to get good air flow but no way can you just stop paying rent. In the subsequent future you can take the landlord to small claims court if it links or ties in with you being sick. Save doctor bills and other receipts and take pictures of where the mold is , more added proof for court.

If the mold and associated illness is getting really serious, you should contact a lawyer. Sometimes all it takes is a letter from a lawyer to change a landlord's mind. Also call a mold remediation professional, who can test the air quality and will give you written test results. You cannot stay in the condo and refuse to pay rent, but if you can provide solid documentation of the mold, you may be able to move out and break the lease.

I would contact the owner one last time, and inform him that if he does not pay for the necessary repairs, you will find a company that does, and deduct the repairs from next month's rent.

Document that landlord was contacted and you gave them a reasonable time to remedy the situation, then inform them that you will be hiring the repair done and the costs deducted from your rent. Document everything you do in case you end up in small claims court. Good luck.

Not sure a bathroom fan would have such great airflow that it would stop mold growth.....
