My husband says that it is ok to drive kids (or anyone) without a seat belt if they are driving slowly...like collecting pop bottles etc during a bottle drive. And getting in and out of a vehicle often.
Is this lawful?

I seriously doubt it. I know in FL newspaper carriers and postal workers are exempt. I'd check state statutes. I think now that DUI arrests have tapered off some, seatbelt ticketing is the latest craze for law enforcement.

What he is referring to is the section of the seat belt law that is made for delivery personnel. It is commonly misused and min-interpreted as any vehicle including kids for bottle drives and such, but the exemption does NOT include personal vehicles at all. It is for Commercial and/or Postal Vehicles only.

Here is the seat belt law in Michigan: Michigan Legislature

The part he is thinking of is Section 710e paragraph "1-g".

There are exemptions that apply to personal vehicles. If you have more passengers than belts and all available belts are being used then you are still in compliance. I don't think I would want to try that one though personally.

ha - welcome to the facist states of america. lol, we even have laws that say what you can and cannot say in front of women and children. Just ask that poor bastard from Standish. We have so many stupid "Nanny" laws it's not even funny.

But to answer your question - if a cop wants to be a dink, he can write you up. But if he's not on some ridiculous power trip, like so many of them are, you won't be harassed.

If you mean the "cussing canoeist". It was over turned. The conviction, not the canoe. LOL

I am in total agreement with children being buckled up, especially if they are being driven around by someone else. I thought the law must apply to adults, and not children, thank you for confirming that.

I am with you completely on this!!! And it doesn't matter how slow he was driving if another vehicle hit HIM.
