My aunt lives in Texas, but her childrens' father lives here. He has never paid child support. Can't she contact Friend of Court here to have his wages garnished?

What state issued the support order? They are the ones to enforce it, she needs to get as much information as possible for them as to where he is living, working, etc. They should be able to contact the MI Friend of the Court for the county in which he resides and get something started. I am assuming Texas is the issuing state. Since that is where she lives, she does not want to relinquish jurisdiction of the support order to Michigan. That would mean her coming to Michigan to make court appearances, etc. She doesn't need that headache. Keep the jurisdiction locally. It may prove at some time that she may have to hire an attorney locally in Michigan to represent her interests here, but I wouldn't cross that bridge until she needs to, if she needs to.

Income taxes (refunds) can be confiscated by any court order be it student loan defaults , wage garnishments , child support , etc . I'm not sure how its done in the case of child support , that would have to be asked from the court who issued the child support order , I'm sure they would do it for you thats assuming he has a tax paying job .

If he has a court order to pay child support and has not paid , its probably a 100% chance he has a warrant out for his arrest
