On a related note, under the Post-911 GI Bill, did he have to retire after August 1, 2009 to be able to transfer the education benefits to the children? I think his retirement became effective in December 2008 or early 2009. He had more than 20 years of service.
My understanding is that he can convert to the post 9-11 GI Bill at anytime. But I'm not sure if conversion can happen after retirement. If he wanted to convert, he probably already would have. Or he did, and just hasn't informed you.
The VA will apportion a veteran's disability and pay it directly to the custodial parent ONLY if the non-custodial parent (i.e. disabled vet) is not paying his court order child support payments. To receive this benefit, you have to write a letter to the VA explaining the situation, names birthday and social of children and veteran involved. They look at each situation on a case by case basis.
It's not a matter of whether or not the VA will pay your children but more whether they will garnish his disability check because he refuses to help support his offspring.
In order for the Post 9/11 GI Bill, the member would have had to transfer it to the children. Not sure if he can go back now and do that or not. They don't automatically get it. Also, he has to transfer his GI BIll to the Post 9/11, as that doesn't automatically get transferred either.
Vets on disability are eligible for a higher amount if they have dependent children.
If your ex is receiving that higher amount, but not passing it on to his children, then it is fraud.
It blows my mind that people automatically assume that a custodial parent, seeking money from her ex, is "just looking for money"... whether or not the deadbeat is a disabled vet, his children still need to eat. Food and shelter cost money. Why do non-custodial parents not understand this basic fact of life?
