My husband is currently in afghanistan. He comes home in August, but has decided he wants a divorce now. I know that I can't file myself while he's over there, and I don't want to, I want to work on our marriage. My question is, can he file while he is over there?
One of the guys in my husband's unit filed here in the state of WA while he was deployed. It was a completely online process. I went with the wife to talk to JAG to make sure all the paperwork was legitimate, and it was. They ended up reconciling in the end, but were well on their way to divorce while he was deployed.
My suggestion - go talk to JAG. They cannot represent you, but they can advise you!
Either of you can file. The Service Member's Relief Act can be waived by him. You probably won't win this fight if he's already asking and has month's left to go.
