I talked face to face with BIL yesterday. He made sense but with him you never know....

This is what he told me. I would like comments as to whether this seems correct:

-His rating is 100% but in six months he has to get an evaluation which may drop his rating back to 60%. If he stays 100% there will not be any more evaluations.

-He has a DD11 and a SD17. Both are dependents and are eligible for college if he stays 100% rated.

-When either kid turns 18 his monthly amount goes down.

Seem factual?

You said he was rated 100 for his knee due to surgery. That’s a temporary rating, and yes, usually VA will reevaluate after the convalescence period to determine his rating after surgery… so there wouldn’t be eligibility to Chapter 35.

I don’t know those forms you mentioned in bullet two, but yes, his VA compensation rate reduces when any dependent children age out (turn 18). They can be readded up to age 23 if they are in school full time (if not receiving or eligible for Chapter 35).

I think that doing anything with that college fund right now would be jumping the gun. Revisit in a few months or another year when you know more. He may not stay 100% disabled.

I'm surprised he hasn't asked for a pay out of that college money. If she doesn't go to college he probably will.
