Has anyone heard any update regarding this, or is it dead?

Per our City Planner regarding this project:
The Monongalia County Circuit Court's decision to uphold the Planning Commission approval of the development's site plan application has been appealed to the Supreme Court of Appeals of West Virginia. The developer has decided to delay the pursuit of building permits and construction initiation until the Supreme Court of Appeals of West Virginia has issued a decision.
It would make sense to wait and see what the court does. Here's hoping that's reaolved quickly so it can be resolved one way or another.
I was just coming to post that, lol. I wonder if this means it is starting to move forward or is finally being heard by the supreme court (supposedly where it is being held up right now). I find it funny them complaining about the building towering over their property, when they just were in a partnership to build another property that "towers" over their property.
I cant wait for this happen as well, but just re-reading the title, I couldnt help but chuckle....can 11 stories really be considered a "tower"? lol....

For some of the anti development people in this town it is, anything over 2-3 stories to them is a tower lol.
I will rejoice when this one and the one on university ave get built (hopefully).
I wonder how things would be if these guys spent their money improving their rental properties instead of fighting growth and economic development in Morgantown...
