So in reality the city of Morgantown is enforcing the state code with only the WV Legislature making any potential changes while both Biafora/Giuliani are wasting air and space on this matter. Am I correct on that assumption?

I believe that is essentially correct. The University has made a sincere effort to protect the city's interests in these arrangements, but Biafora and Giuliani are businessmen, thus they have a vested interest in limiting competition for their investments. I believe they are wrong, and their scare tactics essentially worked in terms of the VFW location development, but they will not win overall because their argument is flawed. However, if you look at it logically rather than emotionally, you can understand why they would attempt to protect their interests.

In the final analysis though, I believe they are destined to lost on both fronts. That VFW property is right next to the Downtown Campus, and if private developers don't develop it (which would have been better for the city government), then it is only a matter of time before WVU steps in and acts unilaterally. That corner is going to be developed. It is just a matter of whether the ground remains property tax exempt as is currently the case with WVU taking ownership, or if an entity like the recent proposal develops it and puts it back on the property tax rolls.

According to today's DP, the parties have agreed to drop the lawsuit, but what happens next is anybody's guess.

Probably, but I believe he is destined to lose this one in the end if enough folks get on board to voice support for the project.
