Out of lock-in (rate, refinance, bank, lender)

I have agreed to lock in my refinance mortgage rate, now I found another bank with better rate .. can I refinance with the other bank? Can the first bank sue me? I have agreed to refinance on the phone .. have not signed any paper yet?

anyone can sue you for anything

winning in court is another story

i would ask the old lender if they can match the rate you got otherwise you're going with a new lender.

i'm sure they'll try to work it out
