We plan to arrive at our North Naples condo early Monday. This will be our first year as Florida residents. If we stay past New Years we will have resided in Collier County for more than 6 months. However, since we have a new Granddaughter in NJ I would like to head back to NJ for the holidays.

What are the chances that anyone (FL government wise) will find a way to check how long we were actually in the state??

Keep all of the utilities turned on for at least 6 months and one day. If NJ is like NY, they will still hassle you for their "fair" share of taxes. Going on vacation to the place you used to live shouldn't count towards residency, but those Northeast states think they own you for life. As always, your mileage may vary......

Tripower455 is right on...we have many friends who do the FL Residency Dance every year. As you know FL doesn't care when/how long someone is in FL. Your previous state, (especially NJ), may care. Of the friends whom have done the 'goodbye NJ/NY, Hello FL' routine, a few were hassled by NJ/NY Tax Div. wanting them to 'prove' their new residency/domicile and 'prove' they were out of NJ for 6 months and a day.

One's new FL domicile is pretty easy to prove, if forced to, with car reg, DL, Voter ID, et al. Proving one is out of one's recently former state for 6 months and a day in a calendar year may require some work.

Couple of medium wealthy friends keep a daily log, (yes a PIA), and note every day 'where they are'. Their effort is to record that they are 'out of NJ' for more than that 6 months pivot. Some even collect receipts from anywhere outside of NJ/NY. A few have been 'audited' to prove it, but all have escaped the wrath of NJ residency tax(es). (One is a semi-retired CPA and she said it was a ballbusting experience, fwiw.)

None of them live full time in FL, and none keep water flowing, etc. None have had to show utility bills with usage...All make certain they are simply 'out of NJ/NY' for more than 6 months and a day, whether it is on a cruise, driving to/from NJ/NY, in Montana, in FL, wherever...

All of this is anecdotal, but hard info from some very smart, careful friends. Make your holiday visit to NJ, but make sure you were 'out of NJ' for at least that magic 6 months and a day, imo. My 50Cts...

Well, NJ should not be a problem. We are only there 3 to 4 months a year. The master plan is: June, July, August and (maybe) December in NJ, September, October, May in SC and November, (maybe) December, January, February, March and April in FL.
