I'm having a new home built and am concerned the preserve behind it is flooded. I know there has been record rainfall this summer but I'm concerned once the house is built and we move in that there will be water back there all summer which can lead to more mosquitoes, humidity or possible flooding on our property. I would like another lot but am already in contract. I've spoken to the builder but have not heard back from them yet about my options, it doesn't sound good though. Am I overeacting? I don't think I am but I'm not from Florida and don't have experience with this. Opinions?

The floor of your house should be 36 inches above the highest point of the road in front of the house.

Do they have other lots available or did you own the lot previously?
If this is in a development that has open spots to build, I would have my attorney draw up a stern cancellation letter if you are not offered a lot that is not in a swampy area. Have him cite the fact that your salesperson never mention the flooding problem and that you feel you have been a victim of fraud on their part, but still want to build your house with them.

If you are in town today go take some pictures of the standing water on the lot............... may help to prove your point.

Thank you all so much for your posts. We worked it out. The water wasn't as bad as we thought. In the aerial shots they sent it looked worse than it was. We saw new closer up pictures and the water is just in the preserve about 4 feet lower than the actual lot. We spoke to an engineer and the builder and all seems fine thank goodness!

I would make sure that the builder and engineer confirm this in writing.
