We JUST moved into out first home last week and now have been informed by our HOA that an offer is on the table for a company to build an easement right next to our property line on the common ground!
So far the board has said no but there is one person on the Board saying yes!
Do we have any rights?
Our land so far is not blocked off by fence or anything it just runs freely into the rest of the common ground.....we were planning on fencing it in but now the thought of this easement and all that comes with it is terrifying!

We are at the top of a hill and they will have to remove trees etc to build it I'm scared of how unstable this will make the land please any advice we don't know where to start

Sewage easement? An easement is just a right to use part of someone's land for a particular purpose.

Do you mean some sort of sewage pumping station?

Wouldn't that just mean a pipe . . I mean, it could be rain water from the sewer. Might not be as big a deal as you think. HOWEVER it seems like this is something that should have been disclosed before you bought the property? maybe . . .

By the way, most subdivision lots these days already have easements (most counties require it); generally 20 feet in the front and five or ten feet on the sides and back of the lot. These are often called utility and drainage easements.

Your situation might be different if it's a PUD or something like that, and the fact that the HOA is having to vote on the issue.

Talk to your HOA and see exactly what it is for. It may be nothing to worry about.

Yeah, we need more details.

Your neighborhood should already have SEWER. Utilities don't usually do this type of infrastructure AFTER the homes are built.

What EXACTLY did the HOA tell you is happening?

I'm thinking they might have discovered they needed a pumping station because of the terrain or other reasons, which isn't uncommon.

They are all over the place, but most of the time people don't even know what they are. The smaller ones that are all underground just look like a manhole cover.

It's from a buisness that is using the land over from ours.....it is cheaper for them to use the sites water system than to build their own station, which is why they are offering money to the HOA for the inconvenience.
It'll be about 15ft to the side of our home which is on a slope and 3 fully grown trees will have to come out which will leave obviously unstable ground

What is "it"?

What kind of business?

What does the notice say EXACTLY?

Without details, we can only guess.

Do you have a say, or is it only up to the HOA? Are they getting compensated by the company?

Where do you live?

I would take the notice you received to the Codes/Planning/Public Works office in the city where you live and show it to one of the city officials there. ESPECIALLY if they want to tap into the sewer line, the city needs to know about it and should already know about it.
