Sorry that this isn't really the same type of post as most in these forums.

This doesn't apply specifically to Nashville but what are the open container laws in TN? I'm going on a fishing trip and, being the gracious host I am, was going to let my passengers have a few cold ones during our 3 hour drive through the state. I want to stress that I won't be drinking, just the passengers.

I'm under the impression this would be allowed however I don't know that for sure so wanted to check. Hopefully someone with concrete knowledge of the law can fill me in. Thanks all.

AFAIK there needs to be a partition between you & the passengers. Otherwise it would be too easy to pass the can. Why spend only 3 hours in the State? If your foot is that heavy, the NPD & the state troopers may be out looking for you.

Well, it only applies to drivers in Tennessee. But I seriously hope you mean what you say about not enjoying a cold one yourself.

Ha I'll be in the state longer, I'll just be on the road for 3 hours until we get to the marina. And I definitely won't be drinking, just didn't want to end up in trouble with the law if I happen to get pulled over. Thanks for your help

Let me preface this by saying I'm in no way a lawyer or giving you legal advice. I just googled the relevent documents.

Here's a reference for the state law

So it looks like so long as your passengers have possesion of the alcohol then you're in the clear. I've heard county law can override state law on this so you'd have to check every county you'll be driving through.

But it looks like on July 1, 2011 the law is going to change so that any open container will be punishable by a class c misdemeanor with a $50 fine (non-moving violation).
