Won't swear to it but I think it's a Rough-legged Hawk.

Red-tailed hawk aka chickenhawk. We have them all over the place. But for the first time ever, we had a pair of bald eagles with a young one appear in early winter and they are still around.

I agree it's not that easy to tell because colouring can vary quite a bit in the birds from lighter to dark, but if you look at the range of the two different birds - (I am assuming the OP took the photo in his area) - red-tailed and red-shouldered and you look at the colouring, the red-tailed hawk is darker than the red-shouldered hawk. Plus, the red-tailed hawk is the most common hawk in N. America. The lack, in the photo, of a more distinctly red tail could simply be a sign that it is a young one.

Identifying hawks can be tough, especially when photographed from the back. I'm not an experienced enough birder to be positive.
