Petting doesn't seem to be, but offering shelter to one apparently is illegal...

Petting...or anything that can be construed as disturbing the animal's normal feeding/breeding/migration cycle (which is pretty much all they do) is still a violation.
You may be able to get out of the ticket, but you'll still end up in court.
