That looks an awful lot like a black widow to me.

we thought the same thing...but its sorta more brown without the black widow marking

My guess is going to be Steatoda, or a type of comb-footed spider. Widows have a particularly round abdomen, while this one looks to be a bit 'flattened' on top. There are different species of Steatoda, here are a few images of different species:

Yes agree, False black widow, 'steatoda grossa female'.
