Hi,

This is my first post on this forum. The reason I joined is to ask about my rights as a tenant who still live at home. I have been living with my grandparents for 20 years, when I was a small child. When I started college several years ago, I began to pay rent because I was able to afford rent with my scholarship. I continue to pay a monthly rent. However, I have never signed a formal lease for this rent because I live with family. I now want to move out and into my own apartment. Even though there was no formal lease agreement, and I have been paying rent, do I still have the same tenant rights as everyone else? Such as those who rent a room from a house or rent an apartment unit?

The right I am most interested in is with personal property. Do I have the right to take my own personal property off of the premises within a reasonable amount of time (such as the 3 day rule)? Would this apply to my situation?

If you don't have a formal lease, but you have been helping out with bills for your living expenses, then I personally don't see a problem with you removing your personal property. Even a landlord cannot keep your personal belongings, as far as I know some of the laws have changed unless you abandon your things.

If you are in a really quandary, I would consult a lawyer, esp. if they have been threatening any legal action on their part.

If there is some problem you will probably have to prove you own the stuff you want to take.

Sounds like you may have been thrown out if you have to ask about your right to take your personal property.

Nebraska Legislature - Revised Statutes Chapter 76

Start at 76-1401 through 76-1449.

What is the 3 day rule? I see no such reference in the statutes, but I admit I didn't read the whole thing...

You always have a right to take your own personal property, so I guess I don't understand what the dispute is?

If the "landlord" is trying to keep your property in exchange for payment of rent, that is illegal. Distraint was abolished, apparently in 1974: http://uniweb.legislature.ne.gov/law...tatute=76-1434

Actually, none of this has happened yet. I have yet to talk to my grandparents about moving out, but I am just preparing for a worst case scenario where they might throw me out. So, no I was not thrown out, but just in case.
