My bonehead sister recently got pulled over (for the third time in a year) without insurance, with suspended license, without registration, and with fake tags. She's got two kids, living on welfare and in Section 8 housing, would like to get all of the above legally but is financially unable to do so at the time. Obviously she shouldn't be driving, but she's got a mind of her own.

The first two times in the last year she was given fines only. I noticed on the court docket that this time around they have increased the misdemeanor level of the charges from level 3 to level 2. Anyone have an idea what the possible consequences/penatlies could be for this third time offense of the charges listed above? She's pretty concerned about possible jail time. Any advice is appreciated.

The ticket usually has a code next to it (like 28-502 for instance) That is the statute. You can either google Nebraska statute xx-xxx ( what it says on the ticket) or go to Nebraska Legislature - Browse Statutes by Chapter and search. It will tell you what consequences she is looking at for her specific charges. Ive only had experiance with DUIs (my brother) and that helped me, but Im not sure exactly with your circumstance. Hope that helps.

Class II misdemeanors are punishable by up to six months in jail. Nebraska Legislature

I doubt she would get jail time yet, but if she continues to thumb her nose at the legal system by continuing to drive without taking care of it, she will end up in jail. She's lucky she has only got ticketed. A lot of places arrest for DUS rather than ticket--especially subsequent offenses.

The lack of insurance and fake tags is almost understandable (only in the sense that insurance and tags are expensive and I doubt being on welfare that she can afford it), driving and maintaining a car is expensive enough, especially given her circumstances- I can feel for her, she has to get where she's going somehow, and I'm sure having kids and busing everywhere is difficult and time-consuming (even though when my kids were younger, I did it that way for years...!)- Is there a way perhaps your entire family could pull together and get the tags, etc. paid for for her, and maybe a few months of inexpensive insurance? I know that seems like an enabling-type thing to do, but it would be more for the kids, you know? Or maybe buy her a bus pas, lol- hope it all works out well for her somehow-
