Hi there,

this april, i bough a house in nj. it is a renovated house done a local builder. he bought the house, did the renovation and sold it to us.

now winter comes, we turned on the heat, outside temp is 40 degree, inside is 60 degree, we set the target of 70 degree, but the house just can't be heated up to the target. the furnace keeps working for over 6-8 hours, non stop...

we asked a technician to come over, the guy told us the furnace the builder put into is way too small. our house is 2600 sqt, the furnace he put into is only 65000 btu, the tecknician said it can only cover half size of the house. The only way to fix it is to change the whole thing, including the condensser, which will cost us over 6000$.

can we sue the builder for not buying the rize furnace and ask him to pay for it?

Buyer beware. The lawyers will suck you for much more than the cost of a furnace upgrade. Do you have a home warranty? It could be covered - my home warranty covered a whole new a/c system that quit working 20 days after moving in -

i don't have a home warranty. cause it is a renovation, not new built.

You can sue anyone you want to- the question is, will you win? Did you have a home inspection? Did they comment on the size of the heater? Was a permit pulled for the renovations? If so, did it the plans that were submitted specify a size for the heater?

By the time you sue, pay a lawyer, be cold all winter you might just bit the bullet and get a replacement.

If you go with a home warranty, read the fine print. A lot of contracts don't cover "pre-existing" conditions. (sound familiar?)

Contact your lawyer and see if the seller got pay yet. If their money still in the escrow account, you might able negotiate and get some money for the new furnace. If they have gotten pay, chance are you have to pay for it yourself.

Talk to you neighbors too, I know there are a lot of contractor in NJ. If your neighbor is one, he might able to do it for you a lot cheaper.

A home warranty probably would not have helped at all. The furnace isn't broken, it's just too small.

Did you get a home inpsection? A good inspector would have pointed out that the size of the furnace was not sufficient for the size of the house.
