check with your town's code enforcement official. In Toms River there is a page called CO (Certificate of Occupancy) Guide. It lists all the things that a rental unit is required to have in order to receive a CO. Toms River's lists the following in regards to window:
10. Screens must be on all windows and free of holes.
11. All windows inside and out should be properly maintained, free from cracks, properly glazed, have proper locking
devices and knobs for all hand cranks.
12. All windows must open and close freely and where needed, channels repaired.
I wouldn't assume anything since every town can have different requirements. According to this though, if your apt. were in TR, your window would not meet requirements.
