There is a law in NJ that mandates 3 years of prison time if convicted of commiting a crime with a firearm. It is known as the Graves law.

Do any legal minds out there know why Jayson Williams did not receive the mandatory 3 year sentence for killing his chauffer?

Not at all familiar with that law but in this case maybe because supposedly it was accidental, of course I've read Mr Williams was drinking that night and alcohol and fire arms are a deadly mix.

I would love for someone versed in this to answer your question

From what I can gather Williams made a plea deal to effectively neuter the mandatory sentencing required by the Graves Act.

So how does that make you feel?

A kid who used a bb gun to try and hold up a gas station, had no record, no trouble but got 3 years in Yardville based on the grave act. He desreved punishment but 3 years?? and Williams gets what, 18 months? and will probably serve 1/3 before he walks.

A mandatory sentencing act to be applied in case of commiting a crime with a firearm. Passage of the act filled an emotional need in the electorate but has apparently been just another feel good law.

Laws should be considered for their effectiveness not their emotional appeal or to validate a legislator's committment in preparation for the next election.

Not advocating this law, but you absolutely deserve 3 years for armed robbery of a gas station.... Even if it is just a BB gun. You deserve 3 years for that even if you werent armed...

Money and power talks in our justice system, and it's not unusual for celebrities to get different sentences than the average joe.

As for the robbery thing, although I agree that a kid committing a crime doesn't make it any less worse, there's also something to be said about indiscriminately throwing young people in prison.
