Check with your local buildings department, none of us have any idea where you are and all codes are local.

The rule I know of is the bigger one goes on the bottom, which appears to be the case. Not sure how else you would do it except having a separate exhaust all the way to the roof.

the smoke pipe going into chimney has to be 1 inch bigger than the boiler smoke pipe

That arrangement of exhaust pipes is OK. If your gas water heater was equipped with a "power vent" that goes into a plastic exhaust pipe, it would have to be separately vented to the outside.
