I got home from work yesterday to find a parking ticket sent to me in the mail. The ticket was for parking within 50ft from a stop sign. Now on the day this ticket was issued for, my husband pulled over behind a car —-that was REALLy parked with no one in it right at the stop sign- and let me and my daughter out of the car so I could walk her to the school door, as soon as me and my daughter were out of the car he pulled off. So can I fight this or would I be wasting my time?

did a person write the ticket or was it some kind of camera thing? if it was just a quick drop off, i wouldnt think a person would have the chance to write that ticket.

There was a cop car behind us who saw me get out of the passenger seat and he said you can’t park here I said I know I know I’m just getting my daughter as I was walking to her door got her out and my husband left as soon as she got out Of the car. The cop did not turn his lights on or follow him at any point.

i got a ticket once in a situation like that. it was an alternative side issue in brooklyn. so the parking becomes legal at 10am and the road is filled with cars parked waiting for that time so they can leave their cards. a pig rides by honking and yelling, nobody leaves. so then he makes an illegal u-turn and gets behind us. at that point, people start driving off. i was in the back so he wrote me a ticket as i left.

i fhought the ticket online (like i do most of my parking tickets). i actually just described exactly what happened and i won that ticket. so i guess you have a chance.

So your husband didn't leave the vehicle and was stopped only to unload passengers?

That's not parking.

"Parking" means the standing or waiting on a street, road or highway of a vehicle not actually engaged in receiving or discharging passengers or merchandise, unless in obedience to traffic regulations or traffic signs or signals.

So you can fight it and quote 39-1-1 and probably be fine. However, I am not a lawyer, nor do I play one on TV, so don't get too cocky in there.
