I need advice on this. I don't want to give a long post so I'll make sure it's as short as possible.

Main jist. I want to kick my roommates out and I want to know if I can call the cops if they refuse.

Here is the story: They refused to pay their actual portion of the electricity for the month of dec, and I do not expect them to comply with paying for the utilities of this month. Leaving me with the burden of paying double. Main reason is because they where not home from Dec 23 until 1st weekend of January. However, the billing cycle dates Nov 20 - Dec 22.

About these tenants. They are a married-elderly couple btw. These people have suddenly decided to move out this month, and they just informed me about moving on the first weekend of January. They found this new job in some nursing home in south Jersey. Regardless of it being so sudden, I agreed to give back their security deposit. Ever since this announcement, they have been out of the house during weekend days, and would return on the weekends.

Additionally, ever since then, I have been trying to get them to pay their portion of the utilities bill for the month of Dec. We are 3 people, so technically the bill has to be split by 3. However, it's been difficult. Other than not replying through text, they gave various excuses as to why they won't/can't pay but the biggest reason is because they where not frequently here from Dec 23 onwards.

After confronting them several times, the wife pays just half of the utilities but the husband refuses to pay the exact portion because of reasons stated. I feel like being taken advantage of, and it's pissing me off.


I am tempted to tell them that this saturday, they have to get all their stuff out of the apartment and they are not allowed to spend the night again. Now if they refuse to listen to me, can I call the cops to force them out? At the same time, would I be able to give them a strict time limit to get their stuff out?


Just to add some important notes:

I am not the Landlord. However the utilities (net, electricity, gas) are under my name, I am the account holder. My name is on the lease since 2018 (they have not signed anything in terms of living here). Yes, the land lord knows what is going on, she is upset about this as well. I do not want to sue because of how much of a hassle it is, and I am going to the military soon.

You've gotta be joking dude.

You think you can get tenants out the door for not paying a portion of one monthly utility bill in the middle of a pandemic?

Eviction is typically a long and brutal process and favors the renter.

I've seen cases where it's taken a landlord over a year to kick out a tenant whom was paying no rent whatsoever. Granted, that was in NYC, but don't think it's easy.

If they're moving out and you only get stiffed two months of utilities, can't you just take it out of their deposit?

Sounds messy. Just leave it alone. They’re leaving anyway, consider yourself fortunate. You’re not the landlord so you can’t lock them out. Even if you were the landlord you can’t lock them out because there’s a moratorium on evictions. Be glad they’re leaving voluntarily and let this be a lesson never to put utilities in your name for a property you don’t own and/or don’t let people not on the lease live in your apartment. Unless they were growing marijuana I can’t see the bill being high enough to justify you spending another minute on it.

...especially when you consider that the OP is NOT the landlord.
I am not about to try to parse the convoluted construct of the OP's arrangement with the tenant, but because the OP is not the landlord, I believe that he/she has no legal standing vis-a-vis an eviction.

Yes, i'm definitely doing that.. but i don't want them anymore to stay here overnight and use my electricity.

what!!!?? these people owe you $35!!? that is reprehensible. they should be thrown out on the streets!!

i think you have shown a tremendous amount of generosity reducing their obligation by $3.

It's not about the money, but i am being screwed with here. If they don't pay their portion i'm paying 79$. I'm already in high financial difficulty because I have been paying double rent so they had an easier time to live here, so now i'm being f'ed again to pay for their electricity?
