So... my boyfriend & I have been together for about 3 years & we moved in to this apartment about 2 years ago. Our situation has been going down hill pretty much since we got here. We just took out the lease again in October. I really did not want to sign the lease because I've been unhappy for some time now, but he guilt tripped me into it & now he's broken my trust & I want out of this lease asap! I know if I leave he will be staying here, so I'm wondering if anyone knows if I'm still going to be held responsible for any fees or anything. Or if the landlord is able to just take 1 person's name off of a lease. I'm not sure how any of this works.

Did you sign the lease as a tenant or just listed as a person who is living there?

The best piece of advice I can give you is explain the situation to your landlord. As long as you are not both breaking your lease - you're just leaving - and your soon-to-be ex can handle the payments... I don't see a problem.

I would also make sure that you are DEFINITELY off the lease and you have a copy indicating you are off the lease. The last thing you want is your ex defaulting on the lease and the landlord coming after you.

But again - talk to the landlord, see what can be done. Each situation is different. And don't go through the boyfriend - speak directly with the landlord.

You may also want to consider having a "release and hold harmless agreement" drawn up (I believe there are free versions on the Web) which maintains that you can't be held responsible for damages your boyfriend causes after you leave. Can't give specific legal advice, but I've been in your place. Ideally, if you can get him to sign it, it's just a little more protection than you would have had otherwise.

Sorry, meant to specify that this would be after your landlord OK'ed your removal from the lease. That's a separate issue.

If your name is on the lease, then you are responsible. If not, walk away.
