1st off the officer filled out everything correctly (so it seems) BUT he did not put the state of my plate in the box and left it blank. Is that enough to have this ticket dismissed?

What happened is I got a ticket for parking at a supposed bus stop and there was signs posted for a bus stop BUT along with those signs there was a prominent red 'NO PARKING' sign placed with them (on same sign post) that read 'No parking monday 1-6pm' and I parked there on a friday. I was confused by that and looked around and seen no bus stop benches, people, or yellow or red paint along the curb and there was a bunch of cars parked there too so I thought I wasn't doing anything wrong and could not figure out the ambiguous signs in the least. Anyhow it's for $54 and if I can easily get out of it because the officer didn't write the state of my plate in the box next to the plate number I'd try that but otherwise I've taken pictures and plan on pleading not guilty in court. What do you guys think?

I think if your time is worth anything, it's easier to just pay the $54 than to waste the time going to court- it's not a moving violation (no points), and it's doubtful that you'll get off on the "no state" technicality. Even if you do, you'll probably end up paying court fees of $30 or so, so what have you really saved- $24?? For me, that's worth about 15 minutes of my time.

"Or", you could demand your constitutional rights to a verified complaint on the document the Cop gave you ( it is only a "NOTICE to APPEAR", your promiss to appear in court on that date)

Sure you can, but you must have much more spare time than I do- I've already spent more time on this parking ticket than it's worth.....

.... and the omission of the state on the ticket won't be enough to help you. If you want to spend the time, your pics of the signs must carry your argument.

In my town, if you plead not guilty they will not subpoena the cop for a parking ticket. He would get 4 hours of overtime. If it's a ticket for parking in a large city you might have to sit in court for 3 or 4 houses just to have your case heard. BUT if you take photos and have a decent case you have a very good chance of having it dismissed.

With all due respect. Are your rights not worth spending a little time for.

Most seam to want to take the easy way out . The Cops have rules they must follow to . I would think the same would go for the police. Why waste their time giving a ticket when it is so easy to beat it in court, and waste everyone's time even the judge 's time dosen't come cheap. Fact is that the court's are aware that they don't have jurisdiction the bring an action against you without a verified complaint( most people don't know this ) they even put the code # on the bottom of the ticket c.p.c.853.9 (California Penal Codes), Check it out !

i recieved a parking ticket that read parking prohibited at all times. but there was no sign. i took pictures to show that there wasnt any signs with my vehicle at the same spot where the summons was issued. requested a dismissal of the ticket but it was denied. what can i do to win this dismissal
