I was in the process to buy a condo in the union city area;
The financing did not go through so the contract to purchase the condo was canceled;
Now, my lawyer wants to deduct from the $6.000 deposit his 450.00 fees + 583 for title search that, he says, "was ordered by the mortgage broker through their law office"
I think my lawyer is just trying to screw me up based on my inexperience,
As far as I know I would pay for the title search only if I close on the contract;
Depends on when the financing fell through. If you had a pre-approval, made an offer, offer was accepted, you got everything rolling (including the title work), financing fell through AFTER the fact I would think that you are still obligated to pay for the title search.
Ask for a copy of the title search, it should tell you what date it was ordered.
