Like many of you, I lost my job and file my first unemployment claim (ever) and, I received the Claim for Benefits letter in regular mail. I called today as told on the form. Went through all the questions and then got the shocking news that I was not eligible! No explanation, nothing. WHAT DO I DO NOW???

Unfortunately, it is very rare that the state reverses a ruling unless they made a mistake. You need to go to your local unemployment office and ask. Dont panic just yet. Maybe it is a bug in the system. How did you lose your job exactly? Let us know how you make out.

By law, you have the right to appeal that denial of benefits.

According to the NJ State's Unemployment web site:
"Every determination that affects your eligibility for unemployment insurance benefits will be given to you in writing. If you disagree, you have the right to file an appeal. Your appeal rights are printed on each determination you receive."

You mentioned that you were denied over the telephone. As others have suggested here, go to your local Unemployment Office. Ask them the reasons for the denial, and ask when you will receive the official denial in writing. Then, if you still disagree, file an appeal.

Info about the procedure for filing an appeal will be on the denial of benefits letter. Also, check out the process on line at:

I was initially denied benefits, appealed the determination, and was then awarded benefits in the appeal.

It takes time -- it was more than three months after I filed for the appeal before I actually got scheduled for the appeals hearing. But you have to be persistent.

In my case, my former employer misrepresented the reasons for my termination. I was able to disprove what they said -- and I won. The good news is that while I was waiting for the appeals hearing, Unemployment still had me file a claim every two weeks, and I got credit for those weeks. When I won the appeal, I received the back benefits in a lump sum. So take heart!

Once you get the reasons for the termination in an official letter of determination, you can decide how you want to proceed.

Thanks for all the replies. I've spent the better half of the day on the phone - on hold of course. I guess I didn't explain myself well. I received the claim form, and, was instructed to call in today but, in that red section of the form you receive. It has down zero in all columns, meaning somewhere along the line my former employer - who went bankrupt and that's why I lost my job - didn't report my earnings BUT I do have my pay stubs. I'm hoping somebody can help me because I do believe I am entitled to unemployment. This is my first claim ever and I'm into my 40s and have been working steady since I'm 21. So hopefully with the proper documentation, I can get this sorted out. Wish me luck and again thanks to those who answered. Diorgirl - you're giving me hope!! Thanks!

This was my first time claiming unemployment as well -- so being denied benefits completely stunned me! The entire process has been a real education -- I'm over 60, so if I can battle it out with them, you sure can! LOL!

By all means haul yourself down there ASAP..if the columns have zeros your former employer may have been making the deductions but not paying the state..if so he is in BIG trouble...if that's the case also request a statement of your earnings from Social Security as he may have pocketed those as well
