Hi all. my daughter was married at the county courthouse in Monmouth county in May 2009. well she realized after the fact its not what she wanted and made a mistake. now she wants an annulment. i know the grounds for it,but the marriage certificate has not been recorded as of yet. is it still a legal marraige? will it be easier since it has not been recorded?

Not necessarily....

I was married in March of '06, yet 9 days later on my honeymoon learned my husband had a pregnant girlfriend on the side.

I too had a legal annulment. Filed in April of '09, and all was not completed until October of '09... which I was told was actually quick: for a 9 day marriage in which we had not even yet acquired joint assets! (That will delay the process substantially.) Even though things are not filed in a timely manner, they are still very much legal. Are you sure she even qualifies for a legal annulment? "Deciding that is not what she wants after all" is not exactly grounds... you have to prove the marriage was fraudulent, otherwise it's a divorce.

Best of luck to your daughter, I know it can be a difficult & painful time.

yes i know about the requirements for annulment. they have no assets at all together. i know impotence is grounds for annulment but do you have to provide proof? her soon to be ex is so heartbroken over this. he did nothing wrong.she just is too young and wants to hang out with her new friends from her new job. im really upset with her to do this to him. but she is my daughter and i accept her choice. thanks

That is harsh. Sorry it is your daughter, but that is REALLY female-dog like. (Cant say the real word).

Well, it is her bed now, let her lie in it. Help her if you can, but let her figure most of this out on her own. If she is old enough to get married on her own, and the only real reason for her to annul/divorce is her own shallow dissapointment, then she is old enough to get herself out of it too.

Kids grow up. Let her.

That's quite a personal story. On behalf or the male gender, I apologize. It's this kind of jerk that gives our gender a bad name. Please be aware that decent men are as repulsed by this as you are.

If it were up to me, I'd string him up with piano wire in the manner causing castration. Though I'm usually no fan of the Dixie Chicks, they got this one right with "Old Earl."
