We are holidaying in NY in November 2010 and Tripadvisor warnings have put me off holiday rental apartments there because of the rental laws (ie there shouldn't be holiday rentals). Is NJ subject to the same restrictions (as I can find holiday rentals there, but don't want to risk doing anything illegal). Thanks, Ann

Do you mean like a weekly rental? I don't think there is anything ilegal about it, unless the person is subletting against the terms of his/her lease (if it's an apartment). People down the shore do weekly rentals all the time, I'm not sure why anyone would advise against it. What exactly did they say?

Sounds like the OP is comming here on vacation and wants to know if there are any laws AGAINST weekly apartment rentals.

Yes, we are coming to New York for a week and Tripadvisor warns against the multitude of holiday apartment rentals (for a week). It says they are illegal. NJ is relatively close and I thought we might stay there, but I didn't want to do anything risky.

I don't understand why they are illegal? Here at the shore, 3/4 of the homeowners rent weekly in the summer, and it's not illegal, they are listed through real estate offices. Maybe the hotels got some sort of non-compete law enacted? Try the NYC visitors Center and find out if they have resources for vacation rentals there. Maybe there are time share rentals available, as well.

In NYC, in co-ops, renting out apartmets a week at a time is usually strictly forbidden by the co-op boards. That's why people like co-ops. It's less restrictive in condominiums, but WEEKLY sublets are discouraged. In rental apartments, it's frankly illegal.
