I live in Hazlet and am being forced to move due to a job relocation. My realitor suggested I get me certificate of occupancy before I list so I could get an idea of what needs to be fixed. I was told that I had to get permits for my shed (because it is too close to my fence) and in order to get a permit for my hot tub I would have to move it seven feet from my house. It's cut into my deck, it would be a significant expense. The hot tub was installed in 1997, shed is about eight years old. Isn't there any type of grandfather clause for these items? Also if I disconnected the hot tub would it still need to be moved?

A C/O expires in 3 months, if it takes longer to sell, you will need to get another C/O. It would have been granfathered if it were built prior to the date the code was adopted. In this case you may be better off to take out the hot tub and frame in the deck floor, also you could drag out the shed to legal limit.
