The board members in Jersey City, New Jersey has announced that it will take possession of unit owners condos (WITHOUT FORECLOSURE) if you owe any back maintenance fees.

Is this legal? Can they take control of my property without going through a foreclosure process. They said the foreclosure process was too expensive so they are finding another legal way to do it?

Please let me know if the condo association can do this..I will end up being homeless.

Wow! I just don't get that. I can understand that the Condo Association can CERTAINLY place a lien against your property for unpaid maintenance fees - but how in the world can they take possession of your unit? It's not like a co-op where everyone has a certain amount of shares. The unit is owned wholly by you - and when you do not pay your mortgage, it is ultimately owned by the bank. The Condo Association does not even come into the picture.

I'm interested in seeing responses from people far more intelligent on the subject than me - and I wish you the best of luck.

Probably not, but what do your condominium documents say?

My own guess is that you may end up needing to consult an attorney. Condominium law and state regulations are complex. You can find the web site for the Department of Community Affairs online. However, I'd start with your documents.

I used to live in a condo assoc and it was horrible. They only raised the fees every year and got less service in return. I will never live in one again.

For this one, there is no way they can take possession of a condo for no maintence fee. Maybe put a lien against it like someone else said, but no more. You own the deed. I would move out asap as it sounds like they are up to no good.
