Is rental income considered "earned income" for NYS unemployment?

I lost my job last awhile back and I'm considering buying a house and renting it out "seems better than the stock market or an annuity"

Should I report the monthly rental income I receive when submitting weekly unemployment claims?

rental income if its not your profession is not earned income

New York State Department of Labor - Before You Apply For Unemployment Scroll down to what is considered work? It says "Any activity which brings in or may bring in income at any time must be reported."

reported is one thing, counted is another. unless its your occupation ,passive income is not counted from investments or rentals. typically these are the rules most states if not all states follow.

The following types of income will NOT affect benefit payments:

earnings for service calls as a volunteer firefighter or volunteer ambulance service personnel (on-call or standby pay does reduce your benefits);
earnings from service in the National Guard or a U.S. military reserve unit;
jury duty or election judge pay;
supplemental Social Security income (SSI) and survivor’s or dependent Social Security benefits;
investment income (including personal IRAs)
rental income from property you own, unless such rental is your primary occupation;
income tax and property tax refunds
child support

what if you lease your business to someone? and it is still incorporated..is this income?

Why don't you just call NYS Unemployment and pop the question to them?
