I work in NYC and live on Long Island. In October 2010 I married a woman who owns an apt in NYC. Since getting married we spend Saturday nights at the apt. Do I have to pay NYC income tax for 2010? Do I also have to pay NYC income tax on a going forward basis even though this is a Saturday night apt?

Probably not if your name isn't on the deed. If your name is on the deed, then yes. Some people have summer homes or weekend homes or whatever, and yes, they have to pay taxes on those...whomever's name is on the deed.

Thanks for your email. My name is not on the deed, it's only in my wife's name, but we are filing a joint tax return. My acct says if you work in the city (or are in the city) 183 days or more, and own an apt you pay NYC income tax -- regardless of whether you stay overnight in NYC 40 nights or so a year. It seems odd that if a person lives outside NYC but works in NYC and buys an apt on Dec 30 that he would pay NYC income taxes for the whole year. Or if I only spend 50 nights in the apt that I should pay income taxes for the whole year.
