Not really going to get into how I was unfairly summonsed for Fare Evasion, but my question is, if you are summonsed for Fare Evasion, do they still let you ride the train, or do they make you leave the station?

You either evaded the fare or not. What did you do?
Also, in regards to your question --- do you mean do they let you ride the train you were hoping to catch when you evaded the fare? Or do you mean, are you "suspended" from riding the train?
If it's the first, the cop can do what he wants --- either make you leave or let you ride
If it's the second, they could never enforce that.
yes, i meant why did they immediately let me ride the train if I "evaded" the fare. I would assume they would throw me out for not paying the fare, and I would also assume they felt bad for me that I had no option to pay for the fare, but needed to ride, so they didnt throw me out
Why did I not pay the fare? because the 4 machines and gate agent's system will not accept credit cards for the last 3 days. So I just figured I'd buy my unlimited pass when i exited the train at the next station. Sorry for having a common sense type brain.
It was amusing when I told the cop the machines weren't reading credit cards and even had messages that said, "no credit cards", and he said, why didn't you go talk to the gate agent, to which my response was, "I did", he rolled his eyes.

1. If the macine wasn't reading credit cards for 3 days, you should have bought your card elsewhere.
2. If you went to the gate agent, they would have buzzed you in. I've had that happen to me --- either the machine wouldn't take my cc or it just wouldn't work and the gate agent has just buzzed us in. It's happened more than once.
3. You evaded the fare --- no excuse! You can go to court and plead your case but the bottom line is, you violated. If the judge "feels sorry" for you, maybe he'll reduce the fine.

Consider it a lesson learned.
1. I bought single ride passes for those days, however today i was riding the subway 4 times, are you saying I should have spent $2.25 for the first ride, than buy the $104 for the unlimited? Was someone going to refund me that $2.25? I should really be overcharged due to their non working systems? Let's say I didn't have $2.25 cash on me, lets say I only had a credit card, they are denying me service because their machines are out of service today?

3. It is an excuse. If their damn machines don't work, let me in, i'll pay somewhere else. Im trying to pay, its not like I ride the subway once a month, I ride it twice a day, and I pay my $104 monthly just like all the other honest people out there. However, if their machines don't work, what should I do?
What is the lesson learned here? The only lesson I learned is that the MTA agents and police are non helpful when their systems are broken.
You can't ever rely on "I hope they will feel sorry for me".
If the credit card machine was out for 3 days why didn't you buy a card at your destination on your first day?
I meant it as they realized they were in the wrong, still letting a fare evader ride their system, because that fare evader, wasnt a fare evader at all, it was just someone who was stuck due to their malfunctioning systems.
they make you walk. kidding kidding. ironically i think after you are processed, the cops escort you into the station so that you're indeed able to use the subway system without paying, because any fine (that's determined weeks later in a court) would be way more than the fare.

That's odd, I'm obviously disputing the summons, theres no reason or right that the MTA, who I've payed over $2200 the last 2 years should charge me $100 when their machines don't work. Dispute the summons or dispute the credit card charge. Either way, no one gets ahead, my payments have went towards my rides, fair is fair, that's all i want, fairness.
well i hate to admit this but i am just giving you my personal experience when i was around 19 or 20 and suddenly found nothing but lint in my pockets. i wasn't exactly the most organized dude back then... i was like man, i'm gonna have to "jump the 'stiles" (the expression used back then. there was no physical jumping involved. it was a figure of speech. however on a few ocassions i did see brazen criminals physically jump). and when i did - boom - an undercover nabbed me. i was taken for processing, charged with "theft of services" and then taken back to the subway station. believe me, after processing when the cop asked 'do you have any questions?' one of the questions was your original question. i think my wording was: so do i have to walk home now? and he said: no. anyway, a court appearance was involved, but not in the same week. i paid a court-determined fine. if, like i did, you have no "priors" (prior convictions) then it helps you in court of course.
