Hi,

I rented out a room in my two bedroom apartment on Craigslist one month ago. I have changed my mind about the person I rented it to and would like to rent it to someone else. I live in a co-op building and own the apartment. A month to month rental agreement was sign by both of us. What is the best way to handle this and can this be done?

If it's a month-to-month agreement, you should be able to talk to your tenant and explain that you don't want to renew it for the coming month. Hopefully, you'll give the tenant as much notice as possible--which I say from my own experience as a tenant.

I believe you have to give 30 days notice. Not sure if it's mandatory for you as the owner but it would be nice.

a 30 day notice is always understood to be a part of a month to month legally. Unfortunatly you should be prepared for your tenant to refuse to leave in 30 days in which case you would have to proceed with an eviction requiring you to go to housing court. You might consider offering money as an incentive.
