My concern regarding offering money for tenants to move with an agreement is that what if they still live there after the date has passed? In this case, don't you still need evict? (I do not know the answer) From what I know, you can sign a settlement in the court. We are taking our tenants to the court. Our case is more complicated than yours (you can evict month to month tenants without reasons, not to mention that they are not paying the rent). We will not give up sue for the back rent and all damages until tenants pay all off. Collection agency is another option for collecting debts. I purchased two landlord legal guide books and they are extremely helpful.

A Petition for non-payment costs less that a Holdover, but the tenant will be able to stay if they pay the rent. If it doesn't seem that they will be able to pay the rent, you can use this less expensive method to evict them. Get an attorney that handles landlord cases and it will usually cost less. They usually work for several cases on the same day so they charge less than if they representing you only on that day. I know a small legal firm that handles this in the Bronx, but I don't know if they represent landlords in Queens. If you are still having the problem, send me an email if you want a referral.
