I signed a lease. My apartment smells really bad. It is making me sick. All management has done is vacuum and cover up the stench with another scent. I seem to be the only one bothered by the smell on my floor. The odor was definitely covered up the day I went to see it. I want out. What are my options? Can I sublease it to someone else?

Read the lease! Maybe contact the Department of Health to investigate the odor. Breaking a NYC lease is not a joke.

I don't find any of these answers helpful. Why is breaking a lease a bad thing? It is unliveable and there is nothing they can do to make me happy.

Who said its bad? Do it. Advise your landlord that you find the apartment unhabitable, and ask to be let out of the lease. If he agrees ask for a signed 'Release'. You can get a form at any Staples store.

Just do things properly, in writing.

Document your complaints and requests. That is don't just call the LL, put it in writing; or, record you calls, and/or get the phone records of your calls.

Document the Ll's Response and efforts made to address the issue.

If you can get a couple of witnesses of the offensive order.

Good luck.

You could ask the LL what they used to mask the smell when you went to see the apt the first time since you didn't smell anything unusual then....

Have you seen a doctor over your sickness?

Thanks Jcoltrane. Sir Klato said it was bad to break a lease, but I don't know why.

Plwhit, I could ask, but I am really not interested in masking a problem. It is only a temporary solution at best lasting a short time.

No, I have not gone to a doctor. I really don't have time to deal with this. I need to find a new place asap.

If I am not able to get out of my lease, is it legal to sublease/sublet?

Read your lease! Sometimes you are allowed to sublet and sometimes you are not -- depends on what the lease says.

Is it possible the smell is coming from the pesticides used to deal with the pest problem?
