You have 90 day from the date of the incident to file a civil suit. The incident happened in the middle of September.
You might want to confirm that with your lawyer because there's no way in hell your lawsuit was served on the city if a police department employee contacted you, period. Believe me or don't, but I know what I'm talking about.
