I moved into a rent stabilized apartment 8 months ago and, prior to signing the lease, had to prove that my income is in a certain range to qualify for the apartment.

My question is this: I plan on getting married in a few months and will want my wife to move in with me. Will this require us to pass the income test again as a couple? (we will probably earn more than the upper limit for this apartment allows). Am I required by law to notify the landlord and add her to the lease?

Any information will be appreciated,
L

You must make over the set amount for two consecutive years AND your rent must be above, is it $2,500 ? There is no "range," unless you mean by that the landlord requiring a certain income.

I did not think income testing for rent regulated apartments was legal - people fought this. Perhaps you should find out what sort of apartment you actually have.

There are no special rules for your apartment. This is the law for all stabilized apartments.

It is quite easy to find answers to these questions.

Your wife/girlfriend can move in with you without further nonsense from the landlord.
If after 2 years the DHCR asks you to prove your combined income AND it has been over $200,000 for each of those 2 years AND your rent is over $2500, your landlord can get the okay to decontrol your rent and charge you market rent when your lease ends.

So you probably have nothing to worry about for at least 3 years.
